Terms of Service

These Terms of Service ("Terms") are an agreement between you and Cosible LLC ("Menular," "we," "us," or "our"), and they govern your use of the Menular mobile application and related services (the "Service"). Please read them carefully. By downloading, accessing, or using Menular, you agree to these Terms. If you do not agree, do not use the Service.

These Terms also serve as the end user license agreement ("EULA") for the Menular app distributed through the Apple App Store. The section titled "Apple App Store terms" at the end of this document applies specifically to that distribution and controls over any conflicting language elsewhere in these Terms.

Eligibility

You must be at least 16 years old to use Menular. By using the Service, you confirm that you meet this requirement and that you are able to enter into a binding agreement.

What Menular does

Menular helps travelers understand foreign-language restaurant menus. You scan a physical menu, and Menular extracts the text, translates and explains the dishes, and can generate an order you can show to restaurant staff, along with pronunciation audio and learning aids. Menular is a travel aid, not a professional translation, dietary, or medical service.

Your account

You sign in with Apple or with Google. You are responsible for keeping your account secure and for the activity that happens under it. The information you provide must be accurate. You can delete your account at any time from the Settings screen in the app.

Purchases, passes, and credits

Menular is not a subscription. We do not auto-renew and we do not bill you on a recurring basis. Instead, the Service offers the following one-time purchases:

• Free scans. A limited number of scans you can use before or without purchasing.
• Scan passes and scan credit packs. These let you scan menus. A scan pass gives you scanning for a set period of time, and a credit pack gives you a set quantity of scans. These are consumable purchases.
• Language Learner add-on. This unlocks the learning features and lets you save up to 100 bookmarks (words, phrases, and dishes). When you reach the limit, you can purchase another add-on to save 100 more. This is a consumable purchase.

The following terms apply to all purchases:

• Billing. All purchases are processed by Apple through the App Store. Prices are shown in the app before you buy. Apple's terms and payment methods apply to the transaction. Menular does not collect or store your payment information.
• When a scan counts. A scan counts against your free scans or your paid balance only when it returns a successful result. If a scan fails, for example because a photo is unreadable, it does not count and nothing is deducted.
• Your entitlements are tied to your account. Your scan balance, any active pass, and your bookmark capacity are linked to your Menular account. Signing out and back into the same account preserves them.
• Restoring purchases. The app includes a Restore Purchases option that asks Apple to restore purchases associated with your Apple ID. Because passes, credits, and bookmark add-ons are consumable products, Apple may not be able to restore them. What can and cannot be restored is determined by Apple, not by Menular.
• Account deletion. If you delete your account, all unused entitlements, including unused scans, any active pass, and any remaining bookmark capacity, are permanently forfeited and cannot be restored. See our Privacy Policy for how account deletion works.
• Purchases are final. All purchases are final and non-refundable, except where a refund is required by Apple's policies or by applicable law. We do not provide refunds based on your experience using the Service.
• Refunds. Purchases are handled by Apple, so any refund that is available is requested from and granted by Apple under its policies. Menular does not process payments directly and does not issue refunds itself.

Accuracy, translations, and dietary information

This section is important, so please read it.

Menular uses automated systems, including optical character recognition and artificial intelligence, to read, translate, and explain menus. These systems can make mistakes. Translations, dish descriptions, ingredient information, taste notes, cultural context, and staff-facing phrasing may be incomplete, inaccurate, or out of date.

Menular is an aid to understanding a menu. It is not a guarantee of what a dish contains or how it is prepared. Do not rely on Menular for decisions about food allergies, intolerances, medical or religious dietary restrictions, or any other situation where an error could harm you. Always confirm ingredients, allergens, and preparation directly with restaurant staff before you order or eat. You use the information Menular provides at your own risk.

Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Attempt to interfere with, disrupt, or gain unauthorized access to the Service or its systems.
• Reverse engineer, scrape, or misuse the Service or attempt to circumvent scan limits, entitlements, or security measures.
• Upload content that is unlawful or that infringes the rights of others.
• Use the Service in a way that violates the Apple Media Services Terms and Conditions or the usage rules that apply to apps obtained from the App Store.

Your content

You keep ownership of the content you create in Menular, such as your staff questions and your saved menus and bookmarks. You grant us a limited license to store and process that content, and to send scanned menu content to the service providers described in our Privacy Policy, only as needed to operate the Service for you.

Intellectual property

The Service, including its software, design, text, and branding, is owned by Cosible LLC and is protected by intellectual property laws. We grant you a personal, non-transferable, non-exclusive, revocable license to use the app for its intended purpose. You may not copy, modify, distribute, or create derivative works from the Service except as allowed by law.

Third-party services

Menular relies on third-party services (including Apple, Google, Supabase, RevenueCat, and others listed in our Privacy Policy). We are not responsible for the acts, omissions, or content of those third parties, and your use of them may be subject to their own terms. You must comply with any applicable third-party terms of agreement when using Menular. For example, your use of the app over a mobile network must not violate your wireless data service agreement.

Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any translation or dish information will be accurate or complete.

Limitation of liability

You use the Service at your own risk. To the fullest extent permitted by law, Cosible LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of the Service.

To the fullest extent permitted by law, the total liability of Cosible LLC for all claims relating to the Service will not exceed one hundred United States dollars (100 USD) in total, regardless of the amount you have paid or how the claim arises. This is a ceiling on damages in the unlikely event of a legal claim. It is not a refund, and it is not an amount we offer to pay.

Some jurisdictions do not allow the exclusion or limitation of certain damages or liabilities (for example, liability for death or personal injury caused by negligence). In those places, the limitations above apply only to the extent the law permits, and our liability is limited to the smallest amount the law allows. Nothing in these Terms limits our liability to you beyond what applicable law permits.

Indemnification

You agree to indemnify and hold harmless Cosible LLC from any claims, damages, losses, and expenses arising out of your misuse of the Service or your violation of these Terms.

Termination

You can stop using Menular and delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms or use the Service in a way that could harm Menular, its users, or others.

Governing law and disputes

These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-law rules. If a dispute arises, please contact us first at support@cosible.com so we can try to resolve it directly. If it cannot be resolved that way, any dispute will be handled by the state or federal courts located in New Jersey, and you agree to that venue.

Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, provide notice in the app. Your continued use of Menular after an update means you accept the revised Terms.

Apple App Store terms

This section applies when you obtain Menular (the "Licensed Application") from the Apple App Store. It is required by Apple and applies in addition to the rest of these Terms.

1. Acknowledgement. You and Cosible LLC acknowledge that these Terms are concluded between you and Cosible LLC only, and not with Apple Inc. ("Apple"). Cosible LLC, not Apple, is solely responsible for the Licensed Application and its content. These Terms do not provide for usage rules for the Licensed Application that conflict with the Apple Media Services Terms and Conditions, and you acknowledge that you have had the opportunity to review those terms.

2. Scope of license. The license granted to you for the Licensed Application is a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control, and as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that the Licensed Application may also be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.

3. Maintenance and support. Cosible LLC is solely responsible for providing any maintenance and support services for the Licensed Application, as specified in these Terms or as required by applicable law. You and Cosible LLC acknowledge that Apple has no obligation whatsoever to furnish any maintenance or support services for the Licensed Application. Support requests should be sent to support@cosible.com.

4. Warranty. Cosible LLC is solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. If the Licensed Application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the Licensed Application to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the sole responsibility of Cosible LLC.

5. Product claims. You and Cosible LLC acknowledge that Cosible LLC, not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession or use of it, including but not limited to (i) product liability claims, (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement, and (iii) claims arising under consumer protection, privacy, or similar legislation. These Terms do not limit the liability of Cosible LLC to you beyond what is permitted by applicable law.

6. Intellectual property rights. You and Cosible LLC acknowledge that, in the event of any third-party claim that the Licensed Application or your possession and use of it infringes that third party's intellectual property rights, Cosible LLC, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.

7. Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

9. Third-party terms of agreement. You must comply with any applicable third-party terms of agreement when using the Licensed Application. For example, your use of the Licensed Application over a mobile data connection must not place you in violation of your wireless data service agreement.

10. Third-party beneficiary. You and Cosible LLC acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
